These terms set out the basis on which Luiza's Art sells original paintings through luiza.art, and what you and the studio can expect from each other. Please read them before placing an order — by ordering, you agree to them.
1.Who you are dealing with
This website is operated by Luiza's Art, the studio of the painter Luiza Gjuzi, based in Durrës, Albania. Throughout this document "we", "us" and "the studio" mean Luiza's Art, and "you" means the person browsing the site or placing an order.
You can reach us by email at [email protected] or by phone on +44 7737 462576. Email is the fastest way to get an answer, and it is the channel we use for everything relating to an order.
By using this website or placing an order you confirm that you are at least 18 years old and legally able to enter into a contract. If you do not agree with these terms, please do not use the site.
2.The artworks
Every painting offered here is an original, hand-painted work. There is exactly one of each — no prints, editions or reproductions are sold unless a listing says so explicitly.
Photographs are taken in natural light and edited as little as possible, but no photograph reproduces a painting exactly. Colours vary between screens, and brushwork, texture and the edges of the canvas read differently in person. Small differences of this kind are part of buying an original and are not a fault.
The dimensions given for each work are the size of the painted surface in centimetres and do not include a frame unless the listing says a frame is included. The medium — oil, acrylic, watercolour, gouache, pastel, ink or charcoal — is stated on each painting's page.
3.Prices and availability
Prices are shown in euro (EUR) and are the price of the artwork itself. Shipping is quoted separately before you pay, and any import duty, customs charge or local tax raised by the destination country is not included.
Because each painting is unique, availability can change quickly. If a work sells or is withdrawn between the moment you place an order and the moment we confirm it, we will tell you straight away and refund anything you have paid in full.
We may change prices at any time, but never for an order we have already confirmed. If a price is listed incorrectly through an obvious error, we will contact you before proceeding and you may confirm the order at the correct price or cancel it for a full refund.
4.Placing an order
When you complete the checkout you are making an offer to buy a painting. The contract between us is formed only when we send you an email confirming that the work is yours and is being prepared for dispatch.
We may decline an order — the painting has already sold, payment was not authorised, we cannot ship safely to your address, or we have reason to suspect fraud. If we decline, you pay nothing and anything already taken is refunded.
5.Payment
Payments are processed by Paysera, a licensed payment institution. Your card or bank details are entered on Paysera's systems and are never sent to, seen by or stored by this website.
What we do record against your order is the order reference, the amount and currency, your name, email address and delivery address, the transaction reference and the payment status Paysera reports back to us. We need these to identify your order, ship it and keep proper accounting records.
Ownership of a painting passes to you when we have received payment in full.
6.Delivery and shipping
Paintings are dispatched from Albania, packed for transit and sent with a tracked service. We will give you an estimated dispatch and delivery window when we confirm the order and send you the tracking details as soon as the work is on its way.
Delivery estimates are estimates, not guarantees. Customs inspections and courier delays are outside our control, though we will help you chase a late parcel.
If you are having the painting delivered outside Albania, any import duty, VAT or customs handling fee charged on arrival is payable by you. These are set by the destination country and we cannot calculate or absorb them.
Responsibility for the painting passes to you once it has been delivered to the address you gave us.
7.Your right to cancel
If you are a consumer in the European Union, the EEA or the United Kingdom, you have 14 days from the day you receive a painting to change your mind and cancel, without giving a reason.
To cancel, email [email protected] within that period. Then return the painting within 14 days, in the condition you received it and in its original packaging — an original canvas is fragile and only its own packaging protects it properly. You pay the cost of the return, and we recommend a tracked and insured service, because you are responsible for the work until it reaches us.
We will refund the price of the painting and the standard outbound shipping cost within 14 days of the work arriving back with us, using the same payment method you used. If a painting comes back damaged through the way it was handled or packed on return, we may reduce the refund to reflect the loss in value.
This right does not apply to commissioned or personalised works, which are made to your specification and cannot be resold.
8.Damaged or incorrect deliveries
Please unpack your painting as soon as it arrives and check it. If it has been damaged in transit, or you have received the wrong work, email us within 14 days with photographs of the painting and of the packaging it arrived in — couriers ask for both when a claim is made.
We will then agree the best remedy with you. Because every work is unique, replacing it like for like is usually impossible, so in practice this means repair by the artist where the damage allows it, or a full refund including shipping.
None of this affects your legal rights in respect of goods that are faulty or not as described.
9.Commissions
Commissions are agreed separately, in writing, before any work starts. The agreement covers the subject, size, medium, delivery window and price, and it forms part of these terms.
A commission normally begins with a non-refundable deposit that covers materials and reserves studio time, with the balance due before dispatch. Luiza keeps creative control over how the subject is painted — a commission is an original artwork, not a reproduction to specification.
Because a commissioned work is made to your requirements, the 14-day right to cancel above does not apply once painting has begun.
10.Copyright and reproduction rights
Luiza Gjuzi remains the author of every painting and keeps the copyright and all reproduction rights in it, including after it is sold. Buying a painting transfers the physical object to you; it does not transfer the copyright.
So you are free to hang, display, lend, resell or gift the painting you own, and to photograph it for your own personal use. You may not reproduce it commercially — as prints, merchandise, in advertising, as a digital token, or as training data for machine learning systems — without written permission.
The photographs, text, layout and code of this website are also protected. You may view and share links to them, but not copy or republish them elsewhere without permission.
The studio reserves the right to photograph works it has sold and to use those photographs in its portfolio, in exhibitions and in promotional material.
11.Reviews you submit
If you leave a review, it must describe your own genuine experience with the studio. Please do not submit anything unlawful, misleading, offensive, or containing someone else's personal details.
Reviews are read before they appear. Once approved, your name, your rating and your words are shown publicly on this site, and they may be shown in other languages. By submitting a review you give us permission to publish it in that way.
You can ask us to take your review down at any time by emailing [email protected]. We may also decline or remove a review that breaks these rules.
12.Using this website
You are welcome to browse, share and link to any public page here. Please do not try to break into any part of the site, interfere with how it runs, harvest content or contact details in bulk, or use automated tools to place unusual numbers of requests.
The site is provided as it is. We work to keep it available and accurate, but we cannot promise uninterrupted access, and we may change, move or withdraw any page, painting or feature without notice.
Some paintings carry a QR code that links to their page on this site. Those links are a convenience for viewers and may change if the site is reorganised.
13.Our responsibility to you
Nothing in these terms limits any liability that cannot lawfully be limited. That includes liability for death or personal injury caused by our negligence, for fraud, and for your rights as a consumer in respect of goods that are faulty or not as described.
Beyond that, we are not liable for indirect or consequential losses — lost profit, lost opportunity, or loss arising because a painting was not delivered by a particular date. Where we are liable in connection with an order, our total liability is limited to the amount you paid for that order.
14.Changes, governing law and complaints
We may update these terms as the studio's practice changes. The version that applies to your purchase is the one published on this page at the moment you placed your order, and the date at the top of this page shows when it last changed.
These terms are governed by the law of Albania. If you are a consumer resident in the European Union or the EEA, you keep the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.
